LEGAL NOTICE AND GENERAL TERMS OF SALE (B2B)
TRIKOASPORTS S.L., with tax ID ESB66143926, hereinafter ZONE3 Spain, responsible for the website, provides this document to its professional clients, retailers, and commercial establishments (hereinafter, "the Professional Client" or "the Distributor") to regulate the commercial relationship and the use of the B2B ordering platform, in compliance with the obligations set forth in Law 34/2002, on Information Society Services and Electronic Commerce (LSSI-CE).
1. Purpose and Scope of Application
Access to and use of this private platform implies acceptance of these conditions, which will prevail over any general purchase conditions of the Client, unless otherwise agreed in writing. ZONE3 Spain reserves the right to modify these conditions, rates, and information on the website at any time and without prior notice, with publication on this portal being sufficient.
2. B2B Registration and Access
Access to the B2B purchasing area is restricted exclusively to professionals in the sector duly validated by ZONE3 Spain after verifying their economic activity (IAE/CIF).
The Client is responsible for the safekeeping of their access credentials.
ZONE3 Spain reserves the right to deactivate or block accounts that show irregularities in payments, prolonged inactivity, or non-compliance with brand policies.
3. Intellectual and Industrial Property
All graphic material, technical descriptions, logos, and designs are the property of ZONE3 Spain or are licensed from the original manufacturer.
License of Use: The Professional Customer is authorized to use ZONE3's images and marketing materials solely for the promotion and sale of products purchased through this official channel.
Prohibitions: Alteration of the products, relabeling, or use of the brand in contexts that may damage the prestige of ZONE3 Spain is strictly prohibited.
4. Pricing Policy and Market Discipline
ZONE3 Spain provides a list of Recommended Retail Prices (RRP) with the aim of maintaining fairness and brand value in the national market.
The Professional Customer agrees to avoid unfair pricing practices or abusive discounts outside of authorized promotional periods.
Any clearance campaign that drastically affects the perceived value of the brand must be communicated or coordinated with ZONE3 Spain.
5. Orders and B2B Logistics
Unlike final consumer operations, B2B transactions are governed by the Commercial Code.
Receipt of Goods: The Customer must review the order upon arrival. Any apparent damage to the packaging or missing items must be noted on the carrier's delivery note.
Shipping Errors: You have a maximum of 48 working hours from receipt to notify any discrepancies between the order placed and the material received.
Cancellations: If the order has already been processed by the logistics warehouse, its cancellation may incur a management fee of €10 for restocking costs.
6. Professional Warranty and After-Sales Service
ZONE3 products come with a 24-month warranty against manufacturing defects.
Management: The Professional Client will act as the first point of contact with the end consumer. They must send graphic evidence of the defect to ZONE3 Spain (info@zone3.es) for technical evaluation.
Exclusions: No warranties will be accepted for nail cuts, damage from prolonged exposure to chlorine, extreme heat, or use in rental/teaching programs without prior authorization.
7. Liability and Force Majeure
ZONE3 Spain will not be responsible for delivery delays caused by force majeure, transport strikes, or lack of supply from the central factory. Under no circumstances will ZONE3 Spain assume liability for lost profits or loss of business opportunities for the Distributor.
8. Applicable Law and Jurisdiction
For the resolution of any conflict arising from the interpretation or execution of these conditions, both parties submit to Spanish law and, with express waiver of their own jurisdiction, to the competence of the Courts and Tribunals of Barcelona.
